Celebrate 2026 Early Bird Promotion Terms & Conditions
- Information on how to enter and the prize form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions. This competition is not valid in conjunction with any other offer.
- Entry is only open to businesses and other organisations that are registered and operating in New Zealand and that hold, or create during the Promotional Period, a Giftiee account with the Promoter, and that add funds to their float with the Promoter during the Promotional Period (each an “Entrant”). Entries must be submitted by an individual aged 18 years or over who is authorised to act on behalf of the Entrant. Both new and existing clients of the Promoter are eligible to enter.
- Employees, directors and contractors of the Promoter, and members of their immediate household, are ineligible to enter. Immediate household means a person who ordinarily resides with that employee, director or contractor.
- The competition commences at 9:00am NZST on Monday 14 September 2026 and closes at 11:59pm NZDT on Friday 9 October 2026 (“Promotional Period”).
- To be eligible to enter, an Entrant must undertake steps (a) to (c) below during the Promotional Period, and step (d) by the time stated in that step (together, a “Qualifying Purchase”):
(a) Create a Giftiee account or hold an existing account with the Promoter;
(b) Pay at least NZD$500 (including GST) to the Promoter in advance for the purchase of gift cards or other products supplied by the Promoter, by adding that amount to their account float;
(c) Have payment for that purchase processed by 11:59pm NZDT on Friday 9 October 2026; and
(d) Ensure that cleared funds for that purchase are received into the Promoter’s nominated account by 11:59pm NZDT on Friday 16 October 2026. - Funds that are not received and cleared into the Promoter’s nominated account by 11:59pm NZDT on Friday 16 October 2026 will not constitute a Qualifying Purchase and any associated entry will be invalid, regardless of the date on which payment was initiated.
- Each Entrant who makes a Qualifying Purchase will receive one (1) entry into the draw. The maximum number of entries permitted per Entrant is one (1), regardless of the number or value of payments made during the Promotional Period.
- The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, business registration and place of business) and reserves the right, acting reasonably, to disqualify any Entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the competition. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
- Entrants must retain a copy of their remittance advice or payment confirmation for their Qualifying Purchase as proof of payment. Failure to produce proof of payment when requested may, in the reasonable discretion of the Promoter, result in invalidation of the Entrant’s entry and forfeiture of any right to the Prize.
- If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, acting reasonably, to determine the identity of the Entrant.
- The draw will take place at 11:00am NZDT on Tuesday 20 October 2026 at 17 Crowhurst Street, Newmarket, Auckland 1023. The winner will be the first valid entry drawn at random from all valid entries received in accordance with these Terms and Conditions. The draw will be conducted by a random selection method that gives every valid entry an equal chance of being drawn. The result is determined by chance alone and no element of skill or knowledge is involved.
- One (1) prize is available to be won. The prize is a NZD$500 (including GST) credit applied to the winner’s Giftiee account, redeemable only towards the purchase of gift cards or other products supplied by the Promoter (“Prize”). The total prize pool is NZD$500 (including GST).
- The Prize will be credited to the winner’s Giftiee account within ten (10) business days of the winner being verified by the Promoter. The Prize is subject to the terms and conditions of the winner’s Giftiee account, including any expiry, minimum order and redemption terms applying to float funds. The winner must hold an active Giftiee account at the time the Prize is credited.
- The winner will be notified by email to the email address recorded on the Entrant’s account within two (2) business days of the draw. If no response is received within five (5) business days, the Promoter will make at least one further attempt to contact the winner by email or telephone before treating the Prize as unclaimed.
- The Promoter will act reasonably in administering this competition. Subject to any rights an Entrant has under the Fair Trading Act 1986, the Consumer Guarantees Act 1993 or other applicable New Zealand law, the Promoter’s decision on any matter concerning the competition is final.
- The Prize is applied automatically to the winner’s account under clause 13 and does not need to be claimed. If the Promoter is unable to apply the Prize because the winner cannot be contacted or verified, is ineligible, or does not hold an active Giftiee account, and that position is not resolved within three (3) months of the draw, an unclaimed prize draw will be conducted at 11:00am NZDT on Wednesday 20 January 2027 at the same place as the original draw, and any unclaimed prize winner will be notified by email within two (2) business days of that draw, with the Prize applied to their account in accordance with clause 13.
- If the Prize is unavailable, the Promoter, acting reasonably, reserves the right to substitute the Prize with a prize to the equal value and/or specification.
- The Prize, or any unused portion of the Prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
- In the event of war, terrorism, state of emergency, government lockdown, pandemic or any other kind of disaster or unforeseeable event beyond the Promoter’s reasonable control, the Promoter, acting reasonably, reserves the right to cancel, terminate, modify or suspend the competition or suspend, substitute or modify the Prize.
- Entrants consent to the Promoter using their business name, trading name, logo and the name, likeness, image and/or voice of their authorised representative in the event they are the winner (including photograph, film and/or recording of the same) in any media for a period of twelve (12) months from the date of the draw, without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products or services supplied by the Promoter.
- If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, acting reasonably and to the fullest extent permitted by law (a) to disqualify any Entrant; or (b) to modify, suspend, terminate or cancel the competition, as appropriate.
- Entrants are responsible for any tax implications arising from their participation in this competition and receipt of the Prize. Entrants should seek their own independent financial and taxation advice. The Promoter is not liable for any tax liability incurred by an Entrant or the winner.
- Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify any rights or remedies available under the Fair Trading Act 1986, Consumer Guarantees Act 1993, or any other applicable New Zealand law that cannot lawfully be excluded or modified (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the competition.
- Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or payment that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any delay in the clearing of funds by a financial institution; (e) any variation in Prize value to that stated in these Terms and Conditions; or (f) use of the Prize.
- The Promoter collects personal information (“PI”) in order to conduct the competition and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and, as required, to New Zealand regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at iGoDirect New Zealand Privacy Policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may use the PI for promotional, marketing, publicity, research and profiling purposes, including sending commercial electronic messages to, or telephoning, the Entrant. Any commercial electronic message sent by the Promoter will clearly identify the Promoter and will include a functional unsubscribe facility, in accordance with the Unsolicited Electronic Messages Act 2007. The Privacy Policy also contains information about how Entrants may opt out, access, update or correct their PI, and how Entrants may raise concerns or complaints regarding the handling of their personal information or a breach of the Privacy Act 2020. The Promoter may disclose PI to entities outside New Zealand in accordance with its Privacy Policy and the Privacy Act 2020. By participating in the competition, Entrants consent to the collection, use and disclosure of their PI in accordance with these Terms and Conditions and the Promoter’s Privacy Policy. Entrants may contact the Promoter’s Privacy Officer at privacy@igodirect.co.nz and, if not satisfied, may complain to the Office of the Privacy Commissioner.
- These Terms and Conditions are governed by the laws of New Zealand, and the Promoter and each Entrant submit to the non-exclusive jurisdiction of the courts of New Zealand.
The Promoter is IGO GROUP (NZ) LIMITED (NZBN 9429051288716) of 17 Crowhurst Street, Newmarket, Auckland 1023 (“Promoter”).
